GENERAL TERMS & CONDITIONS
1. ALLOTMENT: Interested buyers have to apply for allotment of apartment(s) on our prescribed application form along with the booking money. On acceptance of application, Atlas Developments & Holdings Ltd. will issue a provisional allotment letter in favour of the applicant along with the schedule of payment for down payment and balance amount.
2. PAYMENTS: All payments should be made in favour of Atlas Developments &
Holdings Ltd. in the form of Cash/Demand Draft or Pay Order from a schedule bank of Bangladesh. Bangladeshies residing abroad may ensure payments in foreign Exchange by TT or DD as per exchange rate issued by Bangladesh Bank on the due date of installment payment.
3. DEED OF AGREEMENT: After payment of 50% of the total price, the Company and the Allottee shall execute a Deed of Agreement for safe guarding the interest of the Allottee as well as the Company.
4. DESIGN & LAYOUT: Limited changes in the specifications, design and/or Layout of the apartments and other facilities may be made by Atlas Developments & Holdings Ltd. in larger overall interest or due to unavoidable reasons.
5. TITLE OF THE LAND: Proportionate share of land of the project will be transferred to the allottee after payment of all dues. The allottee shall bear all costs such as stamp duties, registration fees, VAT, Taxes related with land and Apartment transfer.
6. POSSESSION TRANSFER: The possession of each apartment & car park shall be duly handed over to the allottee on completion and on full payment of installments and other charges and dues and till then the possession will rest with Atlas Developments &
Holdings Ltd.
7. COMPLETION TIME: Construction is scheduled to be completed by March 31st, 2009.
8. CANCELLETION OF ALLOTMENT: The shedu1e agreed in the agreement for
allotment for all payments by the allottee shall be of the essence of the contract. It is agreed that the allottee will make all payments within the due date, if any delay will make the allottee liable to pay a delay charge. If a payment is delayed beyond 30 days, the
builder has the absolute right to cancel the allotmet and may exercise the right to cancel the allotment by a registered letter post in the name and address of the allottee. In such a case the earnest money paid by the allottee will be fully forfeited. In the case of cancellation of allotment, the allottee will have no claim whatsoever on the builder or on the demised apartment or property for which application and other formalities had been made by the allottee. |
